Website Terms and Use

SONIJI YTS Private Limited. This document is an electronic record under the Information Technology Act, 2000, published in accordance with Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011.

Introduction

Welcome to SONIJI YTS Private Limited, your platform for buying from a diverse range of artisans (“Sunaars”). These Terms govern your access to and use of the sonijiyts.com website, our services and applications (together, the “Services”), and form a legally binding agreement between you and SONIJI YTS Private Limited.

When you use any service on the Platform — product reviews, seller reviews and so on — you are also subject to the rules and policies that apply to that service, and those are part of these Terms. We may change these Terms at any time without prior written notice, so please review them periodically. Continued use after a change means you accept it. By accepting these Terms you also accept our Privacy Policy as amended from time to time.

Use of the website

Content. Material on these pages is general information for your personal use. It is dynamic and may change at any time without notice.

Account management. If you register an account, you are responsible for keeping your account details and password confidential, for limiting access to your device, and for everything that happens under your account. Tell us immediately if you suspect unauthorised use or a breach of security.

Intellectual property. The trademarks, logos and service marks on this website belong to SONIJI YTS Private Limited or are licensed from third parties, and are protected by intellectual property law. They are provided for your information and personal use only and may not be used commercially without the written consent of their owner. The Site and its content, features and functionality remain the exclusive property of the Company and its licensors.

Your account, password and security

  • You are responsible for maintaining the confidentiality of your display name and password, and for all activity under them. If you provide information that is untrue, inaccurate, out of date or incomplete, we may suspend, terminate or block your access.
  • If we believe there is likely to be a breach of security or misuse of your account, we may ask you to change your password or suspend the account for as long as we think appropriate, without liability.
  • Where a device is associated with multiple logins or sign-ups, we may moderate users and their association with devices, to protect customer security and privacy.
  • Your mobile phone number is your primary identifier on the Platform. Keep your phone number and email address up to date, and notify us of a change through OTP verification. We are not responsible for the consequences of use or misuse of information under your account where you have not updated these details.
  • If you let others access your account, they will be able to see and use your account information. You remain solely responsible for everything done under your account.
  • If you have not accessed the Platform for 2 (two) years, your data, including transactional data, will be deleted from our records and will no longer be accessible.

Services offered

SONIJI YTS Private Limited provides internet-based services through the Platform. One of these lets you purchase handcrafted jewellery and related products made by the artisans listed on the Platform (“Products”), using the payment methods offered. Sales are additionally governed by specific policies — our Returns, Exchanges and Cancellation policy and our Payment and Shipping terms — which are incorporated here by reference.

When creating a return request you must confirm, by ticking the box, that the product is unused and has its original tags intact. If a returned product is used or damaged, or the original tags are missing, the request will be declined and the product re-shipped to you. In that case you are not eligible for a refund and SONIJI YTS Private Limited assumes no liability. If you then fail to accept the re-shipped product, you remain ineligible for a refund. These Terms may be further supplemented by product-specific conditions displayed with that product.

SONIJI YTS Private Limited does not warrant that a product description or other content on the Platform is accurate, complete, reliable, current or error-free, and assumes no liability in this regard.

Eligibility

By using the Site you represent and warrant that: (a) all registration information you submit is truthful and accurate; (b) you will keep it accurate; (c) you are 18 years of age or older and/or have full legal capacity to enter into legally binding relations; and (d) your use of the Site does not violate any applicable law or regulation.

User obligations

You agree not to use the Site for any unlawful purpose or any purpose prohibited under these Terms, and not to use it in any way that could damage the Site, the Services or the general business of the Company.

Service modifications

We may alter, pause or cease any part of our services at our discretion, without prior notice or liability. Continued use after a change indicates your acceptance of it. We are not liable to you or any third party for any modification, suspension or discontinuance of the Services.

User contributions

When you share content on our platform you grant us a non-exclusive, royalty-free, indefinite, global licence to use, reproduce, adapt and display that content in connection with the services offered by the platform.

Third-party websites and content

The Site may contain links to other websites, and third-party articles, photographs, text, graphics, music, video, applications, software and other content. We do not investigate, monitor or check these for accuracy, appropriateness or completeness, and we are not responsible for them.

Site management

We reserve the right, but not the obligation, to monitor the Site for violations of these Terms; to take appropriate legal action against anyone who violates the law or these Terms; and to manage the Site so as to protect our rights and property and facilitate its proper functioning.

Privacy and data protection

We are committed to protecting the privacy and security of our users' data in line with the Information Technology Act, 2000, its amendments, and the Personal Data Protection Bill, 2019.

What we collect. We collect personal information when you register an account, buy or sell products or services, take part in promotions or surveys, or contact us. This may include your name, email address, phone number, postal address, payment information and other details needed to provide our services.

How we use it. To process transactions and deliver what you asked for; to improve our website and services; to communicate with you about orders, products, services and offers; to respond to your enquiries; and to improve user experience and platform security.

Storage and security. We use encryption, access control, secure storage practices and compliance with applicable security standards. Your personal data is stored on secured servers accessible only to authorised personnel.

Sharing. We will not share, sell, rent or trade your personal information with third parties except to provide a product or service you requested, when you have given permission, or to comply with legal obligations or legal process.

Your rights. Under the Information Technology Act, 2000 and the PDP Bill, 2019 you may access the personal information we hold about you, request correction of inaccuracies, object to processing, and request deletion from our systems.

Data security. In the unlikely event of a data breach we will notify affected individuals within 72 hours of becoming aware of it, in accordance with the Information Technology Act, 2000 and other applicable legislation.

Consumer protection

In compliance with the Consumer Protection Act, 2019, we are committed to protecting consumer rights. Our policies on refunds, returns and grievance redressal are published on this website.

Returns, refunds and cancellation

Our full policy — the 3-day return window, how making charges are treated, refund options for domestic and international orders, and cancellation — is set out on the Returns, Exchanges and Cancellation page and forms part of these Terms.

Accuracy in product listings

Vendors are solely responsible for ensuring that all descriptions, images and details of their products and services are accurate and complete, and that their listings do not infringe any copyright or intellectual property right.

Payments

We provide payment methods on the platform but are not liable for issues arising from lack of authorisation for a transaction, exceeding a limit agreed between you and your bank, or a payment dispute or decline for any reason.

All payments must be made in Indian Rupees. We may request supporting documents to verify ownership of the payment instrument used.

Transactions and all commercial terms such as delivery and dispatch are a principal-to-principal contract between buyer and seller; the payment facility merely completes the transaction. We act as an independent contractor for all purposes and assume no liability for the products or services listed on the platform. Card transactions are processed through a payment gateway on terms agreed between you and your issuing bank; online bank transfers run through gateways provided by the banks.

Multiple sellers

Products of a particular style may be sold on the Platform by multiple sellers, and the price shown on a listing page may not always be the lowest price for that style, because the seller shown is selected on a number of parameters of which price is only one. On the product page you will have access to the price offered by every seller for that style.

Intellectual property and image use

We uphold respect for copyright and intellectual property rights. All designs, images and content used on the platform must be properly authorised; unauthorised replication of material from external websites or marketplaces is strictly forbidden. We strongly encourage vendors and users to use original imagery or to secure appropriate licences. Even a modified or edited image may constitute infringement if used without permission.

Limitation of liability

The Company's total liability to you for all claims arising from use of the Site or Services is limited to the amount you have paid the Company for the Services or Product in the last twelve (12) months. In no event is the Company liable for indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Site or Services.

Indemnification

You agree to indemnify, defend and hold SONIJI YTS Private Limited, its affiliates, officers, agents, employees and partners harmless from all claims, liabilities, damages, losses, costs and expenses, including reasonable attorney fees, arising out of or connected with your violation of these Terms, your breach of applicable law, or infringement by you or by any other user of your account of any intellectual property or other right.

Warranty disclaimers

The platform is provided on an “as is” and “as available” basis, without representations, warranties or conditions of any kind, whether express, implied, statutory or otherwise, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not represent or warrant that access will be uninterrupted, that there will be no failures, errors, omissions or loss of transmitted information, or that the platform will be secure or free from viruses or other harmful components.

Content moderation

We maintain a strict content moderation policy. Prohibited content includes hate speech, illegal activity and explicit material. Violations can be reported through our reporting tool, and we will act — up to content removal and account suspension — according to the severity of the violation.

Force majeure

We are not liable for any failure to perform where that failure results from a cause beyond our reasonable control, including mechanical, electronic or communications failure or degradation.

Termination

We may terminate or suspend your account if you violate these Terms, engage in illegal activity, or repeatedly infringe intellectual property rights. You will be notified by email, with the grounds for termination and information on any available appeal.

Updates to these Terms

We may update these Terms from time to time. Updates will be notified by email or by a prominent notice on the platform. You have 30 days from notification to review and accept the updated Terms; continued use after that period is acceptance.

Entire agreement, severability, governing law

These Terms, together with the documents they incorporate by reference including the Privacy Policy, are the entire agreement between you and SONIJI YTS Private Limited regarding use of the platform. If any provision is found unlawful, void or unenforceable, it is severable and does not affect the remaining provisions.

These Terms are governed by and construed under the laws of India. You and the Company irrevocably agree that the courts of India have exclusive jurisdiction over any dispute arising in connection with these Terms.

Dispute resolution

Any dispute arising out of or in connection with this agreement, including any question about its existence, validity or termination, will be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996.
